Homeowners Associations (HOAs) offer numerous benefits for homeowners within their associations. A recent report found that, ‘More than 80% of newly-built single-family homes sold in 2022 belonged to an HOA,’ according to the U.S. Census Bureau. Rockaway works with many HOA boards in the Jacksonville and St. Johns county areas providing landscape maintenance services and for homeowners seeking HOA approval for their individual landscape projects. Here are ten benefits of HOAs for homeowners:

1. Maintenance of Common Areas: HOAs typically manage and maintain common areas within a community, such as parks, pools, landscaping, and recreational facilities. In so doing, they support and enhance the overall appearance and value of the neighborhood.

2. Property Value Maintenance: By enforcing community standards and architectural guidelines, HOAs aim to maintain a consistent and aesthetically pleasing appearance throughout the neighborhood, contributing to higher property values over time.

3. Community Amenities: Many HOAs provide access to amenities like community centers, gyms, tennis courts, walking trails, and other recreational facilities. Homeowners can enjoy these amenities without having to maintain them individually.

4. Dispute Resolution: HOAs often have mechanisms to resolve disputes between neighbors, helping maintain a harmonious living environment, which can include addressing issues related to noise, pets, and property maintenance.

5. Enforcement of Rules and Regulations: HOAs establish and enforce community rules and regulations to ensure a certain standard of living. The rules can cover architectural guidelines, landscaping requirements, and other regulations contributing to the community’s well-being.

6. Social Community Building: HOAs also organize events and activities that encourage social interaction among residents, fostering a sense of community and connection among neighbors.

7. Financial Oversight: HOAs typically have fiduciary responsibilities managing dues they collect and budgeting for maintenance and improvement projects. This centralized financial management aims to benefit the association members.

8. Security and Safety: HOAs often invest in security measures, such as gated entrances, security patrols, and surveillance systems, to enhance the community’s safety.

9. Collective Bargaining Power: HOAs often negotiate with service providers for the entire community, potentially securing better rates for services like landscaping, trash removal, and security.

10. Consistent Neighborhood Appearance: HOAs can help ensure a consistent aesthetic by establishing design guidelines for exterior modifications, landscaping, and other visual aspects contributing to a cohesive and attractive neighborhood.

Regardless of these ten benefits of HOAs it’s important to note that the effectiveness of an HOA, as with any other governing body, depends on its management and community support for the rules it creates and enforces. ‘The additional cost of an HOA might be a deterrent to some, but 57% of HOA members say it has made their lives easier,’ according to Forbes. “Exterior maintenance could be the biggest contributing factor. According to our survey, dues primarily go to neighborhood landscaping (64%) followed by security (44%), personal landscaping (34%) and sports and leisure amenities (31%). The same study examined causes for residential disatifaction. “Landscaping issues (34%) are the major contributing factor, followed by design changes (23%) and fencing (23%),” according to Forbes.

It’s advisable to carefully review the HOA rules and bylaws before purchasing a property in a community with an HOA to ensure your alignment with their preferences and lifestyle. Our team at Rockaway Sustainable Landscaping is experienced and successful at working with HOA boards seeking to improve their associations’ landscape maintenance and on behalf of individual association members seeking approval for their landscape projects from their HOA boards.

Homeowners Association, HOA landscape committee responsibilities are focused on maintaining and enhancing the aesthetic appeal, functionality, and overall value of the community’s outdoor spaces. Not all HOAs have a landscape committee, mainly when the association is small and doesn’t maintain common areas. HOA committees more broadly enhance the effectiveness of their management and oversight. The specific responsibilities of your HOA landscape committee will vary, but here are typical ones:

1. Landscape Design and Planning:

Create Requests for Proposals (RFP) soliciting bids from qualified commercial landscape maintenance firms, reviewing submitted bid packages, and making recommendations to the HOA board in the selection process.

Collaborate with contracted professional landscapers or architects to plan and design common areas within the community.

Develop and periodically update the long-term landscape plan to guide the maintenance and improvement of community outdoor spaces.

2. Plant Selection and Maintenance:

Coordinate with landscape management companies to choose appropriate plantings for common areas, considering sustainability, climate, soil conditions, and aesthetic preferences.

Oversee the results of the landscape management company’s regular maintenance of plants, including irrigation, pruning, fertilization, and pest control.

Create rules regarding landscaping-related activities such as tree removal and policies for fencing, residential gardening practices in their space, and handling of hoses, etc in areas the landscape management companies are required to maintain.

3. Hardscape Management:

Manage the maintenance and repair of hardscape elements such as sidewalks, pathways, fences, and outdoor structures.

4. Budgeting and Financial Oversight:

Collaborate with the HOA board to create an annual budget for landscape-related expenses.

Monitor expenditures to ensure that the landscape projects stay within budget constraints.

5. Contractor Selection and Management:

Hire and oversee contractors for landscaping projects, ensuring they meet quality standards and adhere to established timelines.

Solicit bids for landscaping services and negotiate contracts when necessary.

6. Compliance with Regulations:

Stay informed about local landscaping regulations and guidelines to ensure the community’s outdoor spaces comply with legal requirements.

Work with the HOA board to address any issues related to non-compliance.

When board approval is required, provide input to the HOA board on association members’ proposed landscaping projects.

7. Community Engagement:

Communicate with homeowners about what is allowed or not and about upcoming landscaping projects and solicit input on design and plant selections.

Organize community events or volunteer opportunities related to landscaping, fostering a sense of community pride.

8. Emergency Response Planning:

Develop plans for responding to landscaping emergencies, such as storm damage or pest outbreaks, to minimize the impact on the community.

9. Educational Initiatives:

Provide educational resources to homeowners about proper lawn care, water conservation, and other landscaping practices.

10. Aesthetic Guidelines:

Establish and enforce guidelines for individual homeowners to ensure that their landscaping efforts contribute to the overall aesthetic of the community.

By fulfilling these functions, the landscape committee contributes to the overall well-being and attractiveness of the community, fostering a positive living environment for all residents.

Homeowners Association (HOA) and Community Development District (CDD) are both common forms of governance in planned communities, but they serve different purposes and have distinct characteristics. Here are the key differences between an HOA and a CDD:

1. Purpose and Function

HOA (Homeowners Association): An HOA is primarily responsible for managing and enforcing rules and regulations within a residential community. It typically oversees common areas, landscaping, architectural guidelines, and community aesthetics. The HOA collects fees from homeowners to fund its operations and maintenance of shared spaces.

CDD (Community Development District): A CDD is a special-purpose local government entity created to provide community infrastructure and services. This can include the construction and maintenance of roads, utilities, parks, and recreational facilities. CDDs are often established to fund and manage the development of large master-planned communities. “Since 1980, CDDs have evolved into the preferred financing mechanism for residential developers,” according to Kite Capital Partners. “Instead of securing a traditional bank loan to finance this construction, CDDs allow developers to create a special purpose quasi-legislative government for the community. This enables developers to issue tax-exempt bonds that are collateralized by the underlying real estate without incurring upfront development costs.”

2. Governance Structure

HOA: Homeowners within the community are usually members of the HOA and have the right to vote on important issues. The HOA is typically governed by a board of directors elected by the homeowners.

CDD: A CDD is governed by a board of supervisors. Initially, this board may consist of individuals appointed by the developer, but as the community develops and residents move in, elections are held to select board members. Although they are established by county statues they are not dependent upon the counties or municipalities. “For certain infrastructure districts, their boards are initially elected by property owners until qualified electors move in.

3. Funding

HOA: The HOA is funded by homeowner dues or assessments. These fees are used to cover the costs of maintaining common areas, enforcing rules, and managing the community.

CDD: A CDD is funded through bonds and assessments on property owners within the district. The assessments may appear on property tax bills and are used to repay the bonds issued to finance infrastructure development.

4. Scope of Control

HOA: The HOA’s control is typically limited to the enforcement of community rules, architectural guidelines, and the maintenance of common areas and amenities. Multiple HOAs can operate within a given CDD boundaries.

CDD: The CDD has a broader scope, as it is involved in financing, constructing, and maintaining essential infrastructure for the entire community, such as roads, utilities, and recreational facilities in adherence to state and local planning and zoning requirements. Learn more about the History of Florida’s Independent Special Districts.

5. Duration

HOA: The HOA typically exists for as long as the community is governed by its covenants, conditions, and restrictions (CC&R). The CC&R can be amended, but the HOA is generally a long-term entity.

CDD: A CDD may have a limited duration, especially when it comes to repaying bonds. Once the infrastructure is paid off, the CDD may dissolve, or its responsibilities may be transferred to another entity.

It’s important to note that the specific roles and powers of HOAs and CDDs can vary based on Florida laws, local regulations, and the governing documents of each community. Homebuyers and residents in planned communities should carefully review the governing documents of both HOAs and CDDs to understand their rights, responsibilities, and the overall management structure of their community.
